Where BuiltSign works

BuiltSign works in the European Union, Iceland, Liechtenstein, Norway, Switzerland, the United Kingdom, the United States, Canada and South Africa. Here is what that means for your account and your signers.

Short answer

  • When you sign up, you confirm a mobile number from one of these 35 countries. We send a code to it.
  • Signing with an SMS code also only works with a number from these countries. A request you create through New transaction always asks for such a code.
  • Anyone can sign a request without an SMS code through the link in the email, even without a number from these countries. Those are requests from a template with SMS verification turned off, or through the API without SMS verification.
  • The country of your number counts, not where you are at that moment. With a UK number you also get the code on holiday outside Europe.
  • The ID check accepts passports, ID cards, driving licences and residence permits from 237 countries and territories. That list is separate from these 35 countries.

Which law applies where

Per region, the law that governs electronic signatures, with a link to the source where we have one.

European Union

eIDAS Regulation (EU) 910/2014

eIDAS applies directly in all member states. An electronic signature can't be denied legal effect or admissibility as evidence just because it is electronic. A qualified electronic signature (QES) has the same legal effect as a handwritten one. National law decides which documents need a specific form, such as a notarial deed. More on legal validity under eIDAS.

Iceland, Liechtenstein and Norway

eIDAS (EEA)

As EEA countries, Iceland, Liechtenstein and Norway follow the European rules for electronic signatures (eIDAS). Here too, national law decides which documents need a specific form.

Switzerland

ZertES and Art. 14 CO

Switzerland recognises electronic signatures. A qualified electronic signature under ZertES is equivalent to a handwritten signature (Art. 14 of the Code of Obligations). BuiltSign does not make qualified signatures.

United Kingdom

Electronic Communications Act 2000, section 7

Electronic signatures are admissible in evidence under section 7 of the Electronic Communications Act 2000 and are recognised in common law. The Law Commission of England and Wales confirmed in 2019 that they can be used for contracts. In England and Wales a will still needs a handwritten signature.

United States

ESIGN Act (2000) and UETA

The federal ESIGN Act and the Uniform Electronic Transactions Act (UETA), adopted by almost every state, give electronic signatures and records the same validity as paper. ESIGN's rules don't apply to wills, family law matters and court documents, among others.

Canada

PIPEDA (Part 2) and provincial acts

Federal law (PIPEDA, Part 2) and provincial electronic commerce acts recognise electronic signatures. Which documents are excluded, usually at least wills, differs per province.

South Africa

Electronic Communications and Transactions Act 2002 (ECTA)

ECTA recognises electronic signatures for most agreements. Where a law requires a signature without saying which type, only an accredited advanced electronic signature counts; BuiltSign does not make those. ECTA doesn't apply to agreements for the sale of land and wills, among others.

Why not in more countries?

    Only where we have checked the law

    We only offer BuiltSign in countries where we have checked which law governs electronic signatures. That doesn't mean signing elsewhere is invalid: Australia, India and Singapore, for example, also recognise electronic signatures. See are electronic signatures legally binding.

    SMS only where it is needed

    SMS codes are sometimes abused to trigger large numbers of paid messages to expensive numbers. That is why SMS is only switched on for the countries where it is needed.

    Each country has its own SMS rules

    Every country has its own rules on who may appear as the sender of a text message and how people opt out. A country is only added once we follow those rules.

Frequently asked questions about countries

Only on a request without an SMS code. A request through New transaction always asks for an SMS code, and that only works with a number from one of the 35 countries. If you are the sender, send the document from a template with SMS verification turned off, or through the API without SMS verification; the signer then signs through the link in the email. If you are the signer, ask the sender to do that.
Yes. The country of your number counts, not where you are. If your Dutch number receives texts abroad, you also get the code there. The other way round, a number from outside the 35 countries doesn't work, even when you are in the Netherlands.
BuiltSign. The message always mentions BuiltSign. In many countries BuiltSign also shows as the sender. In others a name may not be used as the sender or has to be registered first; there the text comes from our international number. You can see what to expect per country above.
Yes. Phone networks treat these places as separate areas, even though they belong to France, the United Kingdom or the United States. That is why they are not among the 35 countries. If you need such a number, let us know.
Yes. The ID check accepts passports, ID cards, driving licences and residence permits from 237 countries and territories. If the request also asks for an SMS code, the mobile number still has to come from one of the 35 countries.
